Menifee City Attorney Julie Biggs announced today that the Riverside Superior Court has dismissed the Miller v. City of Menifee lawsuit.
Former Menifee Planning Commissioner Mark Miller filed a complaint on July 10, 2012, challenging the termination of his appointment to the commission. Miller failed to respond to the last demurrer to his complaint and the court has granted the city's motion and dismissed the compliant without leave to amend.
“Mr. Miller still has the right to appeal this decision,” said Biggs. “It’s very unlikely that an appeal would overturn this ruling since he failed to submit any opposition and this is at least the third time his complaint has failed.”
